By placing an order with CM40UK, you agree to these Terms & Conditions.
Nothing in these Terms & Conditions affects your statutory consumer rights.
About CM40UK
CM40UK is an independent UK online retailer selling a mixture of new, pre-loved, upcycled, surplus, clearance, discontinued, handmade and personalised products.
Our range changes regularly and some products may only be available in very limited quantities.
Using Our Website
You may use the CM40UK website for personal and lawful purposes.
You must not misuse the website, attempt to interfere with its operation, introduce malicious software or use its content for unlawful purposes.
We may update, change or remove website content and products where necessary.
Products & Descriptions
We make reasonable efforts to ensure product descriptions, photographs, prices and other information on our website are accurate.
Colours and appearance may vary slightly depending on photography, lighting, materials and the screen or device used to view the product.
Measurements provided are approximate unless otherwise stated.
If we discover a significant error in a product description or price after you place an order, we will contact you as soon as possible.
New, Pre-Loved & Upcycled Products
CM40UK sells a mixture of new and pre-loved products.
Pre-loved, second-hand and upcycled products may show signs of previous use, age or natural variation. Where relevant, we aim to describe and photograph significant marks, wear or imperfections before purchase.
An imperfection or characteristic that was clearly described or shown before purchase will not normally be considered an undisclosed fault.
This does not affect your statutory rights.
Surplus, Clearance & Discontinued Stock
Some CM40UK products are sourced from surplus, clearance, liquidation, ex-shop or discontinued stock.
This means quantities can be limited and we may not be able to obtain another item once it has sold.
Packaging may occasionally show signs of storage or handling. Where this is significant, we will aim to make this clear within the product listing.
Personalised & Custom-Made Products
CM40UK creates and sells personalised and custom-made products.
Personalisation may include names, wording, dates, images, designs or other information supplied or approved by you.
Please check all personalisation details carefully before submitting your order.
We will normally create the product using the information supplied by you. CM40UK cannot accept responsibility for spelling or other errors contained in the information you provided and approved.
If you notice an error after ordering, please contact us immediately. If production has not started, we will do our best to make the requested change.
Personalised or custom-made products cannot normally be cancelled or returned simply because you have changed your mind once production has begun.
This does not affect your statutory rights if a personalised product is faulty, damaged or not as described.
Custom Design Requests
We are happy to discuss custom designs and ideas.
Acceptance of a custom request is at CM40UK’s discretion and may depend on the product, material, design and equipment required.
We reserve the right to decline requests that we are unable or unwilling to produce.
Any applicable price and timescale will be agreed before the order proceeds.
Orders
When you place an order through the CM40UK website, you are making an offer to purchase the products in your basket.
Receiving an automated order confirmation does not necessarily mean that we have accepted your order.
An order is accepted when we confirm acceptance or dispatch the goods.
We reserve the right to cancel an order before acceptance if, for example:
A product is unavailable
There has been an obvious pricing or listing error
We are unable to obtain payment
We cannot deliver to the address provided
We are unable to fulfil a requested personalisation
We reasonably believe the transaction may be fraudulent or unlawful
If we cancel an order after payment has been taken, any amount due will be refunded.
Prices & Payment
Prices displayed on the CM40UK website are shown in pounds sterling (£).
The price payable is normally the price displayed when you place your order, together with any applicable delivery charges.
Payment must be successfully completed using one of the payment methods offered through our website.
We may change our prices at any time, but changes will not normally affect orders already accepted.
Delivery
Standard UK delivery is currently £6.95 per order.
We use a range of delivery providers, which may include Royal Mail, Evri, DPD and Yodel.
The carrier selected may depend on the size, weight, value and destination of the parcel.
In-stock products are normally dispatched within approximately 1–2 working days.
Personalised and made-to-order products normally require approximately 5–7 working days before dispatch unless otherwise stated.
Delivery times are estimates and may be affected by circumstances outside our reasonable control.

Free Delivery Promotion
CM40UK currently offers free UK delivery on qualifying orders of £50 or more.
Because our website may not automatically remove the delivery charge at checkout, the standard £6.95 delivery charge may initially be collected.
Where an order qualifies for this promotion, CM40UK will refund the applicable £6.95 delivery charge after the order has been received.
The terms or availability of this promotion may be changed or withdrawn for future orders. Any qualifying order already placed while the promotion was advertised will be honoured in accordance with the applicable offer.
Cancellations, Returns & Refunds
For most goods purchased online, consumers have statutory cancellation rights.
Generally, you have 14 days after receiving eligible goods to tell us that you wish to cancel, followed by a further 14 days to return them.
Certain products, including goods made to your specifications or clearly personalised for you, are normally excluded from change-of-mind cancellation rights.

Faulty, Damaged or Incorrect Goods
Goods supplied by CM40UK must meet the requirements of applicable UK consumer law.
If an item is faulty, damaged, materially not as described or we have supplied the wrong item, please contact us as soon as possible.
Depending on the circumstances and your statutory rights, you may be entitled to a refund, repair or replacement.
Your statutory rights apply to both new and pre-loved goods, taking into account matters such as the description, price and condition disclosed before purchase.

Delivery Problems
Please ensure that the delivery address supplied with your order is complete and accurate.
If an order is delayed, damaged or lost during delivery, please contact CM40UK.
Where appropriate, we will investigate the matter with the delivery provider.
Intellectual Property
Unless otherwise stated, the content created for the CM40UK website, including our branding, text, photographs, graphics and original designs, belongs to CM40UK or is used with appropriate permission.
You may not reproduce, sell, distribute or commercially exploit CM40UK-owned content without permission.
Customer-Supplied Images & Designs
If you provide an image, logo, wording or design for us to use on a personalised product, you confirm that you have the necessary right or permission for us to use that material for your order.
You must not ask us to reproduce material that is unlawful or that infringes another person’s intellectual property rights.
CM40UK reserves the right to refuse a customisation request where we reasonably believe the requested material should not be reproduced.
Discount Codes & Promotions
Discount codes and promotional offers may be subject to additional conditions stated when the promotion is offered.
Unless otherwise stated:
Promotions cannot be exchanged for cash
Discount codes cannot be applied retrospectively
Only one promotional code may be used per order
Promotions may be changed or withdrawn for future orders
Any statutory rights remain unaffected.
Website Availability
We aim to keep the CM40UK website available and accurate but cannot guarantee uninterrupted access at all times.
The website may occasionally be unavailable because of maintenance, technical problems or circumstances outside our reasonable control.
Our Responsibility to You
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
